CONVEYANCE 

By General Warranty Deed subject to all matters of record, except free and clear of all financial or debt interests, and clear of any items relating to any Three Creeks Association matters, which will be cleared at closing.  See Title Report.

TOPOGRAPHY

The topography is diverse, ranging from rolling, indigenous grass and sagebrush high desert foothills, to heavily treed riparian bands along No Name, Wisconsin, Lemon, Nugget, Parsons Creeks, and Marsh Ditch, to desert alpine foothills studded with aspen, juniper and pinon pine, and finally in its upper reaches transitioning into the towering firs and spruces of the Rocky Mountain sub-alpine ecosystem.  There exists a number of incredibly spectacular building sites with views, water, and total seclusion.  There are pristine constructed, and future permitted, pond complexes.  Tens of thousands of acres of public land lie immediately adjacent to the north and east.

 

CONSERVATION EASEMENTS

TAXES

Taxes will be prorated from the day of closing.

 

TITLE

Title will transfer through warranty deed.  Seller is providing title insurance.

 

WATER RIGHTS

Any water rights appurtenant to property will transfer.  All appurtenant rights are conveyed without warranty.

 

WATER

No Name, Wisconsin, Lemon, Nugget, and Parson Creeks and springs.  +/- 7000 ft. of buried pipeline creating numerous developed springs, ponds, and elk wallows.  Additional future ponds and water improvements permitted.

  

MINERAL RIGHTS

All owned by seller will transfer.  Any mineral rights are conveyed without warranty. 

 

FENCING

 
 The ranch has many miles of new fences built for wildlife and pasturage.  All riparian areas are protected.  Over 240 acres of upland range improvement for wildlife are protected.

 

TERMS

Cash, 20% down on sale day.  The balance due at closing within 30 days or less.  The seller of Lemon Creek will require not less than 90 days after closing to move.  Monthly rental equal to 3% of the purchase price, divided by 12 months will be paid to buyer for the interim (Ex. purchase price x 3%/12 = rent per month).  Seller would lease back Lemon Creek for a longer period if buyer wished.  First American Title Company of Madison County, Ennis, MT 59729 (406) 682-5337 will be closing agent for both sellers.  Seller's counsel will draft all conveyance documents for delivery to Buyer at least five (5) business days prior to closing.

SPECIAL LEMON CREEK AUCTION TERMS:  Lemon Creek and home will not be offered for auction until after successful auction of either Three Creeks West or Nugget Creek or both.  The auction of Lemon Creek will be in two phases.  In the initial auction ONLY the top four (4) bidders on Three Creeks West and the top four (4) bidders on Nugget Creek may bid.  If the owner does not accept any bids, then Lemon Creek may be offered at auction to all other attendees at owner's discretion.
   

BUYERS PREMIUM

A 2% Buyers Premium will be added to the winning bid price to arrive at the total contract price paid by the purchaser.

Your bid is considered acceptance of the terms of this auction.  If you, the Buyer fail to close, the down payment is non-refundable.  If the Sellers accept your bid, which is in their sole discretion, and the Sellers fail to close, 100% of the down payment will be returned.  At this time, there is no known reason that the Seller would not be able to close.  All funds are held in the escrow account at First American Title Company of Madison County, Ennis, MT 59729 (406) 682-5337, the closing agent.
